Westchester Man Sentenced For Attempted Aggravated Assault On Cop

A 52-year-old man who took police on a wild ride after attempting to run down the officers pursuing him has been sentenced to more than a decade in prison.

Earlier this year, Kim Carl of Yonkers was found guilty by a jury at trial of five felonies and a misdemeanor for an incident dating back to Sept. 24, 2016, when he drove his mother’s Mitsubishi recklessly, at a high rate of speed and attempted to evade police attempting to pull him over.

On Tuesday, Westchester County District Attorney Anthony Scarpino, Jr. announced that Carl has been sentenced as a predicate violent offender to:

  • Twelve years in state prison for attempted aggravated assault on a police officer;
  • Three to six years for reckless endangerment, which will run concurrently;
  • Three to six years for reckless endangerment, which will run consecutively;
  • Two to four years for criminal mischief, which will run concurrently, and;
  • One year in county jail for criminal possession of a controlled substance, which will run concurrently.

Shortly before 10:30 p.m. on the day of the incident, Carl was driving in Yonkers, when a patrol officer activated his lights and sirens in an attempt to conduct the traffic stop. At that point, Carl proceeded to speed up and drove across the Bronx border, at which point officers in Yonkers ceased their pursuit.

Police said that approximately 10 minutes later, Carl re-entered Yonkers in the same car, prompting officers to begin following him. 

Officers followed Carl into a parking lot at Water Grant Street, when Carl turned his vehicle to face two police cars. Officers ordered Carl to stop, at which point he accelerated in the directions of police, who “were able to jump out of the way, but narrowly escaped being run over.”

While the officers were able to avoid being struck, Carl hit both police cruisers intentionally, causing damage to each, before he once again sped away. Carl took police on a high-speed chase into the Bronx and onto the Major Deegan expressway before he crashed, flipping his vehicle onto its hood near the Willis Avenue Bridge.

Following the crash, Carl was arrested and taken to the hospital, where police took him into custody. Further investigation into the incident found drugs inside Carl’s vehicle.

Carl was found guilty of two counts of first-degree reckless endangerment, one count of attempted aggravated assault upon a police officer, second-degree criminal mischief and third-degree criminal mischief, all felonies. Carl was also found guilty of a misdemeanor count of criminal possession of a controlled substance. He is due to be sentenced later this year when he will face more than 40 years in prison for the various charges.

In court on Tuesday, Judge George Fufidio said, “Yonkers Police showed ‘remarkable restraint’ during the incident with Carl even as he endangered several officers, pedestrians and motorists in Yonkers and the Bronx.”
